PF diz que máfia pagava mensalão a juízes e denuncia vazamento da operação (Folha de S. Paulo): The operation by Brazilian federal police (PF) in Sâo Paulo today busted judges who got monthly retainers of up to R$30,000 to provide favorable decisions.

The PF said its investigations were hampered by leaks.

The state supreme court (STJ), which supervises the case because judges are charged, denied the PF arrest warrants for preventive detention — which were granted in the comparable case in Rio

Polícia Federal desarticulou hoje em São Paulo uma organização criminosa especializada na compra e venda de sentenças judiciais para beneficiar casas de bingo e empresas interessadas em conseguir créditos tributários.

The PF broke up a criminal organization in São Paulo today that specialized in buying and selling judicial rulings that benefited gambling establishments and companies interested in obtaining tax credits.

De acordo com as investigações da PF, essa quadrilha pagava uma mensalidade de R$ 20 mil a R$ 30 mil para desembargadores, juízes, um procurador da Fazenda Nacional e uma funcionária da Receita Federal. O esquema contaria ainda com a participação de policiais civis.

According to PF investigators, the gang paid an monthly sum of R$20,000 to R$30,000 to judges, a prosecutor from the national Treasury, and a female employee of the tax administration. The scheme may have also involved civil police.

Questionado se esse pagamento poderia ser caracterizado como “mensalão”, o superintendente da Polícia Federal em São Paulo, Geraldo José de Araújo, afirmou que era mais um “bingão da Justiça”.

Asked if these payments could be called a mensalão, the São Paulo PF superintendent, Geraldo José de Araújo, said it was more of a “judicial bingo hall.”

The term mensalão (“big monthly”) was coined to describe alleged vote-buying in Congress during Lula I.

Asking and answering this stupid question two paragraphs below the lede in a big news story — before saying who got busted, for example — is an utter wankfest of the kind that the Folha is getting a name for, unfortunately.

Além da mensalidade, segundo ele, a organização criminosa pagaria para os magistrados R$ 150 mil por sentença favorável. A mensalidade de R$ 20 mil a R$ 30 mil seria uma espécie de taxa de manutenção do sistema criminoso.

Along with the monthly payment, said Araújo, the criminal organization would pay judges R$150,000 for a favorable ruling. The monthly payments were a kind of maintenance fee.

Essas sentenças beneficiariam casas de bingo e empresas interessadas em conseguir créditos tributários na Receita Federal. Os bingos também se beneficiariam desses créditos tributários.

The rulings benefited bingo establishments and companies interested in getting tax credits from the federal tax authority. The bingos also benefited from these tax credits.

Araújo disse que as investigações da Operação Têmis não têm relação direta com a Hurricane –deflagrada na sexta passada–, embora as duas investiguem ações criminosas envolvendo casas de bingo.

Araújo said that the investigations in Operation Têmis have no direct relationship with Operation Hurricane — conducted last Friday — although both have to do with crimes related to bingo halls.

Leak

Araújo disse que houve vazamento de informações sobre a operação desencadeada hoje em São Paulo. “Há um mês houve vazamento de informações”, disse o superintendente da Polícia Federal em São Paulo, Geraldo José de Araújo.

Araújo said information was leaked about the operation carried out today in São Paulo. “A month ago there was a leak of information,” he said.

Segundo ele, o vazamento dessas informações atrapalhou as investigações e dificultou a coleta de provas. “Isso atrapalhou muito. Algumas provas desapareceram.”

According to Araújo, the leaks hampered the investigations and made evidence difficult to collect. “This hampered us a lot. Some evidence disappeared.”

Para a PF, as informações vazaram por meio de uma empresa de telefonia –cujo nome não foi divulgado–, que repassaram os dados para policiais envolvidos com a quadrilha.

According to the PF, the information leaked out through a telephone company — whose name was not released — that passed the information to police involved in the scheme.

Segundo o superintendente, há um grupo de lobistas que atuava em nome de empresários e casas de bingo junto ao Judiciário. Os policiais acusados dariam proteção para as empresas, além de ajudar a buscar informações para os lobistas. A funcionária da Receita ficaria responsável pela facilitação dos créditos tributários.

According to the PF superintendent, a group of lobbyists acted in the name of business owners and bingo halls in the courts. The police accused in the case protected the companies as well as finding out information for the lobbyists. The tax authority employee was allegedly responsible for facilitating tax credits.

A PF apreendeu nesta sexta-feira cerca de 40 quilos de documentos nos gabinetes de desembargadores, de juízes e de um procurador da Fazenda Nacional.

The PF apprehend some 40 kilos of documents in the offices of presiding judges, judges and a prosecutor for the National Treasury.

Na Procuradoria da Fazenda Nacional a PF apreendeu 35 quilos de documentos, além do HD (disco rígido) de um computador no gabinete de um procurador. No gabinete do desembargador Roberto Haddad a PF apreendeu dois quilos de documentos, um notebook e um HD de computador. A PF também apreendeu documentos e o HD do computador da juíza Maria Cristina Cukierkorn, da 23ª Vara Federal.

At the Treasury office, the PF seized 35 kilos of documents, as well as the hard drive of a computer in the office of a prosecutor. In the office of judge Roberto Haddad, the PF seized two kilos of documents, a laptop and a computer hard drive. The PF also seized documents and a hard drive from the office of Maria Cristina Cukierkorn of the 23td Federal Bar.

A PF informou ainda que chegou a pedir a prisão de cerca de 40 pessoas acusados de envolvimento com a suposta organização criminosa. Mas o STJ (Superior Tribunal de Justiça) negou o pedido de prisão temporária. O relator do caso é o ministro Felix Fisher. O caso foi para o STJ porque envolve desembargadores.

The PF said it had requested arrest warrants for nearly 40 persons suspected in the scheme, but the state supreme court denied its request for preventive detention. The supervising judge is Felix Fisher. The case was sent to the STJ because it involves judges.

De acordo com as investigações da PF, que começaram depois de uma denúncia do Ministério Público Federal em agosto de 2006, a quadrilha contaria ainda com a participação de policiais. A investigação foi interrompida há cerca de um mês, quando funcionários da companhia Telefônica vazaram informações sigilosas sobre grampos telefônicos para os policiais civis, que avisaram por sua vez os investigados. Quando a organização criminosa começou a queimar provas, o STJ foi avisado.

According to PF investigations, which began after a complaint from the federal prosecutor’s office in August 2006, the gang also counted on the assistance of police. The investigation was interrupted for nearly a month when employees of Telefônica leaked secret information on telephone wiretaps to the state police, who warned the investigation targets. When the criminal organization began destroying evidence, the state supreme court was tipped off. 

A denúncia só foi confirmada pela PF no final da tarde desta sexta, quando a Superintendência de São Paulo fez uma coletiva. Araújo ainda disse que donos de bingos chegaram a pagar R$ 150 mil a magistrados por uma liminar que garantiria o funcionamento de suas casas. Os bingos também se beneficiariam desses créditos tributários.

The accusation was only confirmed by the PF late Friday afternoon when the superintendent’s office in São Paulo held a press conference. Araújo also said that bingo owners paid as much as R$150,000 to judges for a court order to allow their businesses to operate. The bingos were also favored with tax credits.

Nesta sexta-feira, 20, a Polícia Federal apreendeu pilhas de documentos, discos rígidos de computadores e pelo menos cinco veículos, durante a Operação Têmis, que visa a combater suposta venda de sentenças judiciais e lavagem de dinheiro no Estado de São Paulo. Foram realizados mais de 80 mandados de busca e apreensão nas casas e escritórios de 43 pessoas – entre desembargadores e juízes federais, empresários e advogados -, nas cidades de São Paulo, Rio de Janeiro e Campo Grande.

On Friday, April 20, the PF apprehended piles of documents, hard drives from computers and at least five vehicles during Operation Themis, which set out to combat alleged selling of judicial verdicts and money laundering in the state of São Paulo. More than 80 search warrants were served at the homes and offices of 43 persons — among them federal judges, businessmen and lawyers — in São Paulo, Rio de Janeiro and Campo Grande.

Eles são acusados de envolvimento com uma organização criminosa especializada na compra e venda de liminares para beneficiar casas de bingo e empresas interessadas em conseguir créditos tributários. A PF pediu ao Superior Tribunal de Justiça (STJ) a prisão preventiva dos investigados, mas o juiz federal Félix Fusher negou. The suspects are accused of involvement in a criminal organization specializing in the buying and selling of court orders favoring bingo houses and companies interested in obtaining tax credits. The PF asked the state supreme court to authorize preventive custody of the targets, but federal judge Félix Fusher [sic; it's Fischer] turned them down. Among the suspects were senior judges Alda Bastos, Nery da Costa Jr., and Roberto Haddad, as well as judges Maria Cristina Cukierkorn, from the 23rd Federal Bar, and Djalma Moreira Gomes, of the 25th Bar.

Segundo informações da revista Consultor Jurídico, a Polícia Federal teve de suspender a Operação Têmis depois de descobrir o vazamento de informações sigilosas.

According to reports from Consultor Jurídico magazine, the PF had to break off Operation Themis after discovering the leaking of secret information.

Mesmo com a interrupção, a PF conseguiu cumprir 80 mandados de busca e apreensão. Na capital paulista, a polícia invadiu o prédio do Tribunal Regional Federal da 3ª Região e da Justiça Federal para vasculhar gabinetes de desembargadores e juízes. Apreendeu documentos, notebooks e HDs de computadores.

Even with that interruption, the PF managed to serve 80 search warrants. In São Paulo, the police raided the building of the regional federal court for the 3rd Region and the ministry of justice to search through judges’ chambers. They seized documents, laptops and computer hard drives.

Na operação, são investigadas 43 pessoas, entre juízes, desembargadores, advogados, um procurador e uma servidora da Fazenda Nacional, policiais e empresários. O vazamento das informações teria partido de um funcionário de uma concessionária de telefonia. De acordo com a Polícia Federal, ele contou a um dos policiais investigados sobre a existência das escutas telefônicas e este avisou os colegas.

Forty-three persons are being investigated in the case, among them judges, attorneys, a prosecutor and an employee of the Treasury department, and police and businessmen. The leaking of the information came from an employee of a telephone concessionaire. According to the Federal Police, he told one of police under investigation  about the existence of the wiretaps, and the policeman told his colleagues.

As buscas desta sexta-feira foram feitas em casas de juízes e nos gabinetes. Policiais federais estiveram nos gabinetes de pelo menos dois desembargadores e dois juízes federais: os desembargadores Nery da Costa Júnior e Alda Maria Basto e os juízes federais Djalma Moreira Gomes e Maria Cristina Barongeno. As pessoas ficaram sem acesso aos prédios. O juiz Djalma Moreira não concedeu nenhuma liminar em favor do funcionamento de bingos. A investigação contra ele se dá porque seu nome é citado nas escutas telefônicas.

Há uma linha de investigação que liga as operações Têmis e Hurricane. Na primeira, parte dos investigados pela suposta compra de liminares são donos de bingos. Na outra, foram presos os desembargadores do Tribunal Regional Federal da 2ª Região José Eduardo Carreira Alvim e José Ricardo Regueira, o juiz do Tribunal Regional do Trabalho da 15ª Região Ernesto da Luz Pinto Dória e o procurador regional da República João Sérgio Leal Pereira.

There is a line of investigation connecting Operations Themis and Hurricane. In the former, some of the suspects are owners of bingo halls. In the latter, [three judges and a federal prosecutor] were arrested.
