Procuraduría destituyó y suspendió por 18 años a Jorge Noguera por ‘parapolítica’: Former DAS director Jorge Noguera, appointed by President Uribe, has been dismissed and banned from holding public office for 18 years. He still faces criminal prosecution.
Why mention it in a blog ostensibily dedicated to technology Big Digs?
Because among the findings of the sentence was that he got a substantial (10%, allegedly) kickback for an IT contract the DAS signed with a firm called MT Base/Sybase of Colombia, a subsidiary of Impsat, acquired by Global Crossing in 2006.
Which could make it an interesting case to study alongside the Cisco flap in Brazil.
The outsourcing of public services to third parties as a method of governance “innovation,” meanwhile, might remind gringos of the flap over Blackwater — on whose board sits (sat) the brother of the U.S. Dept. of State’s inspector general, as we read in the W$J today.
It could remind cariocas of Batman and the Scuderie le Cocq, by the same token. On the topic of tech Big Digs and politics as a family business, Mexicans might think of ISOSA and Hildebrando.

Si hay un ex funcionario que se pueda considerar como el símbolo del escándalo de la ‘parapolítica’ en el país es el ex director de DAS, Jorge Noguera. Considerado inicialmente como uno de los protegidos del presidente Álvaro Uribe –quien lo nombró en el cargo- Noguera fue el primer peso pesado en quedar en evidencia por sus relaciones con los paramilitares.
If any former government official can be considered the symbol of the “parapolitics” scandal here it is former DAS director Jorge Noguera. Initially considered a protegé of Uribe, who named him to the post, Noguera was the first high-ranking figure to be probed for ties with the paramilitaries.
Luego de año y medio de investigaciones y tras las revelaciones de SEMANA sobre su proceder al frente de la policía estatal colombiana, Noguera acaba de sufrir el más duro golpe propinado hasta el momento por la Procuraduría a funcionario alguno envuelto en el escándalo: Destitución e inhabilidad de 18 años y la confirmación de que las sospechas sobre sus vínculos con las autodefensas eran ciertas.
After a year and a half of investigations, and revelations by this newsweekly about his actions at the head of the Colombian state police, Noguera has just suffered the harshest blow yet dealt by the state prosecutor to an official involved in the scandal: Removal from office and an 18 year ban on holding public office, along with the confirmation that suspicions about his ties with the paramilitaries were correct.
Las conductas atribuidas al ex funcionario ameritaron investigaciones desde distintos frentes. La Fiscalía asumió el penal, proceso más bien traumático, dado que al momento de ser requerido para que respondiera por sus actos Noguera estaba en el exterior, en donde huyó por varios días argumentando que no tenía dinero para comprar un tiquete hacia Colombia. Su excusa se caía de su peso. Finalmente fue investigado y los medios informaron ampliamente sobre su caso incluso contra los regaños del presidente Álvaro Uribe, quien se empeñó en asumir su defensa. Fue capturado primero, puesto en libertad gracias a una argucia jurídica y luego otra vez apresado. La bola de nieve creció y ya hay más de medio centenar de políticos investigados por el mismo caso.

Al margen del proceso penal en la Fiscalía, la Procuraduría también investigó las faltas en que incurrió el ex funcionario y sus conclusiones, reveladas este viernes por el Ministerio Público, no podían ser peores para Noguera. Lo hallaron responsable de colaboración con paramilitares e incremento injustificado de su patrimonio y el de terceros con dineros públicos.
Alongside the criminal case being built by the Fiscalía, the Procuradoría is also investigating misconduct by the former official, and its conclusions, revealed Thursday by the Public Ministry, could not be worse for Noguera. They found him responsible for collaborating with paramilitaries and illicit enrichment of himself and others using public money.
Como si eso no fuera suficientemente grave, la Procuraduría también comprobó que Noguera obstaculizó investigaciones en su propio beneficio y que no hizo nada para evitar las adulteraciones de los antecedentes de varios narcos pedidos en extradición.
As if that were not serious enough, prosecutors also proved that Noguera interfered with investigations to benefit himself and did nothing to avoid tampering with the criminal records of various narcos who were in the process of being extradited.
Entre los hallazgos de los investigadores se pudo establecer que Noguera mintió respecto a $10 millones que recibió de Liliana Del Castillo. Según él, eran un préstamo, pero la realidad es que hacían parte de las comisiones que el funcionario cobraba por la adjudicación de contratos a la firma MT Base. Del Castillo es esposa de Rafael García Torres, ex jefe de informática del DAS nombrado por Noguera y hoy testigo estrella contra los políticos involucrados en el escándalo.
Among the findings of the investigators was that Noguera lied about the $10 million he received from Liliana Del Castillo. According to him, it was a loan, but in reality it was part of the commissions he charged for ruling on contracts with MT Base. Del Castillo is the wife of Rafael Garcia Torres, a former head of IT at the DAS who was named by Noguera, and today a star witness against the politicians involved in the scandal.

Según la Procuraduría, Noguera “no tenía ningún interés en perseguir a autodefensas y narcotraficantes, sino únicamente a las Farc”, filtraba información a paramilitares, con quienes tuvo estrechos vínculos y a quienes alertaba sobre procedimientos judiciales en su contra. Del mismo modo torpedeó investigaciones contra la familia Dávila Armenta, una de las más poderosas de Magdalena y mencionada por supuestos vínculos con autodefensas. Entre la documentación manipulada por el ex funcionario había listados de propiedades que vinculaban a los Dávila con la familia Noguera Cortes.
According the Procuradoría, Noguera “had no interest in pursuing the narcos or the AUC, just the FARC,” leaked information to the paras, with whom he had close ties and whom he tipped off to legal proceedings against them. Likewise he torpedoed investigations against the Dávila Armenta family, one of the most powerful in Magadalena and allegedly tied to the “self-defense” groups. Among the documentation manipulated by Noguera were lists of properties that tied the Dávila to the Noguera Cortes family.
