Brazil: “Consultor Jurídico Sounds False Note on E-Vote”

Consultor Jurídico runs an article reporting that “Congress proposes to strip the federal elections tribunal of the power to oversee the electronic voting system.”

Amilcar Brunazo Filho, who runs the Voto Seguro e-voting forum, and testified at the congressional hearings that led to the setting up of a subcommittee on e-voting security — see Brazil: E-Vote Gets the Attention of Congress — objects strenuously to the story.

He writes to his mailing list (I subscribe):

It is totally distorted. It says that congress wants to control the TSE’s e-voting machines. What nonsense! It proposes nothing of the kind!

CJ is involved in another flap at the moment over an exclusive interview with a woman identified as a translator involved in the Telecom Italia spy case.

The TSE would continue to have administrative control, but would no longer have the power to regulate oversight of the system, given that up until now, its regulation simply has not permitted effective quality control of the system.

The same company hire by the TSE to produce a quick count in Brazil’s last national election went to do the same thing in the Ecuadoran elections, and failed to produce a result.

Its executives fled the country to avoid an elections fraud probe.

Just look at the Alagoas case. In October 2006, it was discovered that nearly 50% of the voting achines had corrupted control files (log files) and an audit of the vote-counting process was requested involving a technical analysis and access to the digital records of the vote. To date, one year later, the elections authority has not permitted either this technical audit or access to the vote records, based on the bizarre argument that election regulations (which it wrote itself) do not provide for an audit based on a recount of digital votes. 

A proposta do projeto de lei citado na reportagem é apenas que o Congresso, e não mais o TSE, passe a determinar que documentos físicos e digitais o administrador eleitoral (que continuará sendo o TSE) deverá fornecer regularmente aos fiscais (que continuará sendo os partidos políticos).

The bill cited by the report in CJ proposes merely that Congress, not the TSE, determine which physical and digital documents the elections authority (which will continue to be the TSE) must provide regularly to election monitors (which will continue to be the political parties.)

The report is completely distorted and readers wind up being roundly disinformed, as you can see from the comments thread.
