Alagoas 24 Horas (Brazil) reports on the arrest of police accused of involvement in a death squad that murdered the son of a reputed pistoleiro in the northeastern state.

Commenting on the story, reader Pelópidas Argolo illustrates a certain obtuseness about the concept of due process of law:

Em entrevista coletiva, realizada na tarde desta sexta-feira, na sede da Polícia Civil, em Jararecica, o delegado Geral da instituição, Carlos Alberto Reis e os delegados que investigam o assassinato do estudante Diego Ramires Pinheiro – filho de Fernandes Fidélis – prestaram esclarecimentos à imprensa em relação a prisão de três acusados de integrar um grupo de extermínio que atua no Estado.

In a press conference held Friday at police headquarters in Jacarecica, state police chief Carlos Alberto Reis and the police investigators working the murder of student Diego Ramires Pinheiro — the son of Fernando Fidélis — answered press questions about the arrest of three men accused of belonging to a death squad in Alagoas.

Diego had been accused of a murder himself.

A federal lawmaker, Chico Tenório (PMN), has been indicted on charges of ordering the murders of Fidélis and Chico Belem, his driver and bodyguard, in 2005.

Tanto Cícero Belém quanto Fernando Fidélis eram investigados pela Polícia Federal como integrantes do crime organizado em Alagoas, e uma semana antes de morrer, Belém iria prestar um depoimento ao juiz Durval Mendonça Júnior sobre as atividades criminosas no Estado.

Both Cícero Belém and Fernando Fidélis were under investigation by federal police as members of organized crime, and a week before his death, Belém was to give a statement to Judge Mendonça about crime in the state.

The incident generated a so-called “War of the Police,” with murders left and right of mob-tied policemen and other potential witnesses, such as the sons of the original victims — generally attributed to “shredding of documents.”

Tenório (PMN) is a former police delegado. The newspapers seem reluctant to write much about him.

At the same time, a decades-old old crime was also laid at the lawmaker’s doorstep by a former police colonel recently sentenced to 27 years for a series of assassinations (ibid., November 29):

O ex-tenente-coronel Manoel Cavalcante disse agora há pouco em depoimento à Justiça que o deputado federal Francisco Tenório (PMN) foi quem mandou matar o cacique Íbis Menino, da tribo Wassu, de Joaquim Gomes. O crime ocorreu no final da década de 80; o cacique, que exercia liderança política na região Norte do Estado e se destacava no movimento indígena, foi assassinado depois de ter sido parado numa falsa blitz da polícia. O crime era um dos que estavam no rol da impunidade, até a revelação de Cavalcante apontando o mandante.

Former Lt. Col. Manoel Cavalcante said just now in testimony before the court that federal deputy Tenório (PMN) was the one who ordered the killing of Chief Íbis Menino of the Wassu tribe in Joaquim Gomes. The crime occurred in the late 1980s. The chief, who wielded political power in the northern part of the state and was a notable leader of the indigenous movement, was murdered after being detained during a false police raid. The crime had figured on lists of cases of impunity until Calvacante made his charge.

On the proceedings that led to the indictment against the federal deputy, Extra (Alagoas) noted, in rather jumbled syntax:

No inquérito percebemos, ainda, o que é mais grave, o receio de alguns delegados de polícia para presidirem os trabalhos investigativos, bem como, algumas das testemunhas e/ou partícipes, quem sabe, co-autores, simplesmente foram assassinados e, não poderá, por dever de ofício, assistir a tudo isso como fatos corriqueiros, muito pelo contrário, temos a obrigação de adotar as medidas judiciais que se fizerem necessárias ao esclarecimento dos fatos quando competente este juízo.

In this case we are witnessing, even more seriously, the reluctance of some police commanders to lead investigations, and also witnesses and participants, and, who knows, accomplices, have simply been murdered, but we cannot just stand by and accept this as an everyday occurrence, on the contrary we must adopt the proper measures to clarify the facts in this case.

The local bar association has been screaming for federal intervention against organized crime in the state, but the state assembly and the governor have refused to authorize it.

The federal justice minister is starting to politely suggest that the state government does not want the federal assistance offered — under a new state-federal cooperation agreement — against organized crime because the state government is an organized criminal enterprise.

The response tends to sound something like this:

The federal police continue to investigate the lawmaker — who had his sister sworn in as a commissioner of the state accounting oversight board, responsible for auditing the expenditures of the state assembly, in a hasty midnight ceremony a while back — and say they are closing in on the guy:

Desde a última quarta-feira, 26, foram expedidos 4 mandados de prisão e 8 de busca e apreensão, nas cidades de Chã Preta, Viçosa, Cajueiro e Maceió. A operação que contou com a participação de 33 policiais civis e 30 policiais militares, culminou na prisão de Arconso Pereira Florentino, conhecido como Arconsinho Tenório, do cabo da Polícia Militar Carlos Iran de Oliveira Alves e o policial civil Antônio Jorge Júnior além da apreensão de duas pistolas, sendo uma de calibre ponto 40 e outra de calibre 380.

On December 26, four arrest warrants and 8 search warrants were issued in the cities of Chã Preta, Viçosa, Cajueiro and Maceió. The operation was conducted by 33 state judicial police and 30 state military police and ended in the arrest of Arconso Pereira Florentino, aka “Arconsinho Tenório,” as well as military police corporal Carlos Iran de Oliveira Alves and state judicial policeman Antônio Jorge Júnior, and in the apprehension of two pistols, a .40 and a .380.

De acordo com o delegado geral da PC, Carlos Alberto Reis, as investigações que correm em segredo de justiça apuram o envolvimento de 20 integrantes na quadrilha de extermínio que pode ter ligação em diversos crimes ocorridos em Alagoas. “Dos quatro mandados apenas três foram cumpridos, já que Maélio Pereira de Farias não foi localizado. Nós da polícia não vamos permitir e nem perdoar quem comete crime no Estado” afirmou Reis.

Os delegados José Rangel de Ataíde, Regional de Viçosa e Emanuel Davi, distrital de Viçosa foram designados pelo delegado Geral como delegados especiais para dar prosseguimento as investigações a partir de hoje.

Os presos estão sendo acusados dos assassinatos de Silvano Colto e Diego Ramires, respectivamente cunhado e filho de Fernando Fidelis, além do atentado a um segundo filho de Fidelis, Fernando Fidelis Júnior. O cabo Carlos Iran e o policial civil Antônio Jorge estão presos na sede do Batalhão de Operações Policiais Especiais (Bope). Já Arconso Pereira Florentino encontra-se detido na sede do Tático Integrado Grupo de Resgates Especiais (Tigre).
